We inform you that the general conditions of sale, set out below, indicate, in compliance with the regulations in force for the protection of the consumer, the conditions and methods by which to proceed with the online purchase on the site Vspacegalleryshop.com, from now on referred to as Seller, of the products of your interest in a safe, easy and convenient manner. Therefore, please read and accept them in order to proceed with your purchase. The Seller reserves the right to change these general conditions of sale at any time by reporting them on the site.
Any contractual or extra-contractual liability on the part of the Seller for direct or indirect damage to persons and/or property caused by the non-acceptance, even partial, of an order is excluded.

MODE OF PURCHASE

Products are purchased by accessing the site and registering for it. For each of the products, a description containing their main features is available on the site. All supporting purchase information is intended as general information material only.

It is understood that the picture accompanying the description of the product may not be perfectly representative of its characteristics, but differ in color, size, accessory products in the picture.
The correct receipt of the order is confirmed by the Seller by an automatic e-mail response, sent to the e-mail address provided by the customer at the time of registration. Such a confirmation message will contain an order number, to be used in the event of any communication with the Seller. The message will show all the data entered by the customer, who undertakes to check their correctness and promptly notify any corrections.

In case of non-acceptance of the order, the Seller shall ensure timely notification to the customer.

1 – Shipping
The shipping address you provide must be accurate and complete. We are not responsible for delays or delivery errors caused by incorrect information provided by the customer.

We make shipments within five working days after receipt of order and payment. Delivery times may vary depending on the destination and exceptional circumstances beyond our control.

The seller is not responsible for misunderstandings caused by insufficient address provided by the Customer. Goods travel at the Customer’s risk, and claims for delays, breakdowns and losses resulting from transportation will not be accepted, even if the goods are free of port; such claims must be made to the courier before the goods are picked up. For each order placed, the seller issues a sales document for the shipped material.

No responsibility can be attributed to the seller in case of delay in processing the order or delivery of what was ordered. Upon delivery, the customer is required to check that the packaging is intact, neither damaged, nor wet, or otherwise altered.

Any damage to the product or packaging or the mismatch of indications, must be immediately contested to the courier by affixing WRITTEN CONTROL RESERVE, on the courier’s proof of delivery. Once the courier’s document has been signed, the customer will not be able to make any objection about the external characteristics of what has been delivered.

The goods are delivered by contracted express courier.
If the mode of delivery is not satisfactory, please kind customers not to evaluate our service negatively as the courier is not an employee of our company. The product will be replaced as soon as possible.

Delivery charges are the responsibility of the customer and are indicated when placing the order.

2 – Payments
All prices on the site are intended to be public prices and, therefore, include VAT.
Prices are subject to change without prior notice, and the only correct price is to be understood to be that stated at the time of order confirmation.

Goods are sent only after order acceptance and receipt of credit.

The seller reserves the right to ask the customer for additional documents proving credit card ownership. In the absence of sending the documentation, the seller reserves the right not to accept the order. Transaction security is ensured by a data encryption system (SSL) and direct, secured and certified links.
Payments can be made in several ways: Credit Card or PayPal and Bank Transfer.

In case of cancellation the amount is refunded to the customer’s PayPal account.

3 – Complaints
Goods must be verified upon receipt. COMPLAINTS ARE ACCEPTED ONLY IF MADE BY MAIL OR MAIL. NO TELEPHONE COMPLAINTS ARE ACCEPTED. Attach a photo to the complaint. No complaints will be accepted after three days of receipt of goods (packaging, damage, discrepancies).

4 – Right of Withdrawal
Customer rights are protected by Legislative Decree 206/2005 as amended. The Customer has, therefore, the right to withdraw from the contract, even partially, without explanation and without charge, provided that the withdrawal is communicated by registered letter A/R to GLIACROBATI – Via Ornato 4 – 10131 Turin – Italy, within 14 working days from the day of receipt of the products. Notice may be given in advance, within the same period, by e-mail (to info@gliacrobati.com) or telegram, provided it is confirmed by registered A/R mail within the next 48 hours. Such notice must specify the intention to withdraw from the purchase and the product or products for which the right of withdrawal is to be exercised, attaching a copy of the transport document. The Customer must then return the product at its own expense to GLIACROBATI – Via Ornato 4 – 10131 Turin – Italy.

The consumer must then provide, using a courier of his choice, to ship the product (in its original packaging and, in any case, always carefully packed) and complete with every accessory and everything originally contained. The consumer must make such shipment within ten business days from the date he or she sent the notice of exercise of the right of withdrawal.

This right applies to all products purchased online at this site, excluding products delivered sealed and subsequently opened by the customer. The cost of returning the product is the responsibility of the consumer.

he right of withdrawal is totally forfeited if the returned product is not intact, due to the absence, for example, of integral elements of the product (accessories, manuals, etc.) or because the product has been damaged for reasons other than transportation from the Seller to the consumer, not previously reported.
Without limiting the right of withdrawal, upon delivery of the product the consumer, who has reason to believe that the product itself has been damaged in transit, must either refuse delivery or accept it with express reservation.

Important notes for the right of withdrawal.

Transportation costs and responsibility for the goods during shipment, as required by law, are the responsibility of the consumer.
We therefore recommend that you insure the product with your chosen carrier, taking care to pack the goods carefully, where possible by placing the original packaging in an outer box and, in any case, avoiding damaging the product with adhesive tapes, labels, etc. The product must be returned undamaged and complete with all its parts and accessories. In the event of shipping damage occurring during the return, the Seller will notify the consumer within five business days of receipt of the product, allowing the consumer to file a claim with the carrier used for transportation. Damaged merchandise will be made available for return and the return request will be cancelled at the same time.

Except as hereinafter provided for the case of partial withdrawal, the Seller will refund, within 30 days from the time when the Seller became aware of the exercise of the right of withdrawal, the full amount of the purchase and the transportation costs for delivery, by transfer procedure on the credit card or by bank transfer to the bank account indicated by the consumer; the consumer shall be responsible for the transportation costs for the return of the product.

If the withdrawal is partial (i.e., it concerns only a portion of products delivered in a single delivery), reimbursement of shipping costs incurred by the consumer for delivery of the products at the time of purchase is excluded.
Regarding purchases with pickup at a Seller’s store, the right of withdrawal does not apply since this is not a distance sale. In fact, in that case, the consumer has only reserved the product via the Internet, but has not yet purchased it, and in order to do so he or she will have to go to the point of sale.

Request for Cancellation of Order
The purchase order may be cancelled in full if, at the time of the cancellation request, the shipment of the product is still being prepared and, in any case, if the amount has not yet been collected, in which case no charge will be made to the customer.

If at the time of the request for cancellation of the purchase order the product is already entrusted to the carrier or, in any case, the amount has been collected, the consumer must exercise the right of withdrawal and return the goods to the Seller.

For purchases made by Credit Card/PayPal payment, the refund will be made to the customer’s PayPal account.
The Customer shall be liable for any diminution in value of the returned goods resulting from handling other than what is necessary to establish the nature, characteristics and operation of the goods.

Notwithstanding the above, the right of withdrawal is not allowed in the case of:

  • Purchase of sealed packaged products, opened by the Customer;
  • of goods that by their nature cannot be returned or are likely to deteriorate or alter rapidly;
  • Tailor-made products, i.e., directions dictated by the customer at the time of purchase (e.g., fabric cutting, customization, made-to-order products, etc.).

5 – Judicial Competence
The contract of sale between the customer and the seller is concluded in Italy and governed by Italian Law. Insofar as not otherwise stipulated, the relevant Italian law applies. For any dispute that may arise, the parties expressly acknowledge the territorial jurisdiction is exclusively that of the Court of Turin.

PERSONAL DATA.
Pursuant to and in accordance with Leg. 196/03 (so-called “Privacy Code”), the parties declare that they have mutually informed each other that the personal data collected for the formalization of this deed are subject to processing in the Customers/Suppliers file and are necessary for the proper management of civil and fiscal obligations. Such data may also be processed for management, statistical and commercial purposes. The parties holding the respective data also expressly declare that they are aware of the contents of Art. 7 of the aforementioned decree.
